Breakdown of Experience
Asbestos: As Counsel for Liberty Mutual, I was responsible for handling and managing asbestos products and non-products declaratory judgment actions, as well as with assisting reinsurance claims with billing and collections on asbestos products and non-products settlements.
Automobile Liability/Property: In my roles as Reinsurance Counsel and Ceded Reinsurance Manager, I was directly involved in the placement of automotive liability, property per risk and property catastrophe treaties as well as catastrophe swap agreements and catastrophe bonds.
Bad Faith/Eco: As Counsel for Liberty Mutual, I handled declaratory judgment actions involving allegations of bad faith and coverage for extra contractual obligations, and was involved in the settlements of several of these actions. As Counsel and as Manager of Ceded Reinsurance, I was responsible for the contract wording for ECO/XPL in our treaties.
Catastrophes (Casualty): As Manager of Ceded Reinsurance, was responsible for annual renewal and placement of the corporate WC Catastrophe treaty, and worked with the brokers on the development of a casualty catastrophe treaty.
Commercial Property: As Manager of Ceded Reinsurance for Liberty Mutual, I was responsible for the placement of Property Per Risk treaties, Property Catastrophe treaties, Catastrophe Bonds and Swaps. As Counsel and as Manager of Ceded Reinsurance, I handled the contract wording for these commercial property contracts.
Commutations: In my roles as Reinsurance Counsel and Ceded Reinsurance Manager, I was directly involved in commutation negotiations with several reinsurers, as well as the drafting of commutation agreements.
Contract Wording: In my roles as Reinsurance Counsel and Ceded Reinsurance Manager, I drafted manuscript property and casualty reinsurance treaties, revised standard contract wording contained in renewing reinsurance contracts, and created a revised facultative certificate conditions form for facultative contracts.
Environmental/Pollution: As Counsel for Liberty Mutual, I handled and settled many declaratory judgment actions brought by policyholders seeking coverage for their environmental and pollution related liabilities.
MGA/MGU: In my role as Reinsurance Counsel, l worked directly with certain MGAs and MGUs on claims and underwriting issues. I also developed a state of the art template MGA/MGU agreement for Liberty's use.
Workers' Compensation: As Counsel for Liberty Mutual, I drafted many workers' compensation legal memos for claims addressing coverage issues. As Ceded Reinsurance Manager, I was responsible for working with the brokers on placements for the annual renewal of the WC Cat Treaty, as well as any revisions to the contract wording.

Biography
Elaine Caprio is an ARIAS-U.S. certified arbitrator, mediator, attorney and insurance company executive and officer with 35 years of experience forging resolutions to U.S. and international business disputes. Through Caprio Consulting, which Elaine founded in 2014, she has served as an arbitrator or umpire in over 60 matters involving contract, consumer, banking, insurance and reinsurance disputes. Elaine is currently the Chief Reinsurance Officer for R&Q Re (in Liquidation), where she is responsible for managing the valuation of proofs of claim, as well as recovering outwards reinsurance. Before forming Caprio Consulting, Elaine held insurance and reinsurance related operational and legal roles at Liberty Mutual Insurance for over twenty-five years, including Vice President and Director of Ceded Reinsurance. Elaine was a Board member of ARIAS-U.S. from 2005 through 2012, and served as Chairman from 2011 through 2012.
