This Arbitrator and Umpire seminar will address will address two topics of interest to both newly-certified and experienced arbitrators.
In one session Daryn Rush and Kelly Tsai of O’Melveny & Myers will address privilege issues, including reinforcement of some of the basics of privilege law, supplementing the presentations on privilege at the Spring Conference. The presentation will turn to the common interest doctrine and issues of waiver, and practical considerations for a panel tasked with addressing privilege claims.
Experienced arbitrators Susan Mack and Debra Hall will lead the second session that will cover panel drafting of awards post-hearing or on summary disposition. Topics that will be covered in this session include the elements of a reasoned award, issues with respect to the award of interest or sanctions, considerations in whether and how to issue a dissent and at what stage of the proceedings, and the mechanics of drafting and issuing enforceable subpoenas. We will conclude with practical considerations including how to approach deliberation and initial drafting.
After each of the two presentations, we will break out into several facilitated roundtables where each attendee can share experiences and view and learn from the perspective of others, making this seminar valuable and enjoyable.
This program is designed to provide a refresher for experienced arbitrators and a learning experience for less experienced arbitrators in an interactive format over a half a day.

This workshop counts towards the ARIAS•U.S. Certification and Recertification requirements.
CLE Credit:
ARIAS•U.S. is an accredited provider of New York State and Pennsylvania Continuing Legal Education. NY/PA CLE credits are available to those who attend this seminar; all credits are for areas of professional practice. CLE Credits for IL are pending.
