Seth Goldberg is an Assistant Vice President at TransRe, within the company’s D&O/E&O claims unit. Seth handles D&O matters involving securities class actions, derivative litigation, regulatory & criminal investigations, fiduciary liability and employment practice claims. He also regularly handles E&O claims against lawyers, accountants, insurance agents, real estate agents, architects, engineers and other professionals. Seth handles all cyber claims for the D&O/E&O claims unit. Before TransRe, Seth practiced law for ten years, representing (re)insurers in complex coverage matters, and defending professional liability claims. He also managed primary and excess E&O, professional liability and cyber claims for a global insurer. Seth holds a J.D. from St. Johns University School of Law, where he served as Articles and Notes Editor of the St. John’s Law Review, and a B.A. in Political Science, Philosophy, and Law from Binghamton University.

Cyber Snare? The Insurability of Regulatory Fines
As cyber and privacy regulations proliferate, enterprises face significant compliance risks. Mistakes can be costly; regulators may be empowered to level staggering fines for non-compliance and even shut down information processing until compliance is achieved. Some laws also provide a private right of action for consumer lawsuits. In this panel, we will provide an overview of the regulatory landscape and discuss the different approaches taken by cyber insurers offering regulatory coverage, highlighting significant differences in the coverages provided under various cyber policies, and the insurability of regulatory fines and penalties under a variety of applicable U.S. and foreign laws.
