ARIAS·U.S. Dispute Resolution Process

ARIAS•U.S. Rules
ARIAS•U.S. has promulgated the following procedural rules for use in insurance and reinsurance arbitrations: ARIAS•U.S. Rules for the Resolution of U.S. Insurance and Reinsurance Disputes; ARIAS•U.S. Neutral Panel Rules for the Resolution of U.S. Insurance and Reinsurance Disputes; and ARIAS•U.S. Streamlined Rules for the Resolution of U.S. Insurance and Reinsurance Disputes. ARIAS•U.S. recognizes that arbitration exists by agreement of the parties. Parties can agree to arbitrate under these rules when they enter into the operative insurance or reinsurance agreement or at a subsequent time. Simple arbitration clauses for the adoption of these rules either individually or in combination are provided.
Code of Conduct
The continued viability of arbitration to resolve industry disputes largely depends on the quality of the arbitrators, their understanding of complex issues, their experience, their good judgment and their personal and professional integrity. In order to properly serve the parties and the process, arbitrators must observe high standards of ethical conduct and must render decisions fairly. The provisions of the Code of Conduct should be construed to advance these objectives.
Practical Guide
ARIAS•U.S. has created this Practical Guide to Reinsurance Arbitration Procedure (2004 Revised Edition), an update of its 1998 Guide, as a reference for arbitrators, insurance and reinsurance professionals, and attorneys involved in reinsurance arbitrations. The Guide draws principally from the experience and expertise of the ARIAS•U.S. membership and offers sample forms and practices for use in reinsurance arbitrations. The purpose of this Guide is to promote fairness, effectiveness, and efficiency in reinsurance arbitrations, i.e. the integrity of the process.
